KIDS Act

This bill bars the detention of children with cognitive disabilities and primary caregivers of children with cognitive disabilities and bars immigration enforcement within 1,000 feet of a vast list of "sensitive locations":

  • Healthcare Facilities: Medical or mental health care facilities, including hospitals, doctor's offices, accredited health clinics, vaccination or testing sites, urgent care centers, and community health centers.

  • Educational Institutions: Public or private schools (preschools, primary, secondary, colleges, and universities), early childhood education programs, vocational or trade schools, and workforce training sites.

  • School Activities & Transport: Scholastic or education-related events (like field trips and interscholastic competitions), as well as school buses and school bus stops when children are present.

  • Children's Facilities: Playgrounds, formal recreational facilities, child care centers, before/after school care centers, foster care facilities, and group homes for children.

  • Disaster & Emergency Relief: Locations providing disaster or emergency relief (distribution sites for food/water/supplies, temporary shelters, evacuation routes, and disaster assistance or family reunification registration sites).

  • Social Services & Assistance Organizations: Facilities serving vulnerable groups, including domestic violence shelters, child advocacy centers, drug/alcohol counseling centers, rape crisis centers, family justice centers, homeless shelters, and food banks.

  • Places of Worship & Ceremonies: Churches, synagogues, mosques, or other places of worship/religious study, as well as the sites of funerals, graveside ceremonies, weddings, or other religious and civil ceremonies.

  • Public Gatherings: The site of any public demonstration, such as a march, rally, or parade.

  • Legal & Judicial Offices: Federal, State, or local courthouses (including immigration courts), legal counsel offices, probation offices, and court-related service facilities.

  • Government & Public Assistance Offices: Congressional district offices, Social Security Administration (SSA) offices, and public assistance offices (such as unemployment or labor law reporting sites).

  • Public Infrastructure: Departments of motor vehicles (DMV) premises (indoor and outdoor), public libraries, and polling places during an election.

  • Labor Locations: Labor union halls or union-operated hiring and referral buildings.

  • Executive Discretion: Any other location specified by the Secretary of Homeland Security.
