CLEAR Act of 2025

This bill seeks to enhance the role of state and local law enforcement in immigration enforcement.

  • Affirms the inherent authority of states and localities to assist in the enforcement of federal immigration laws, by stating that federal immigration law does not preempt such state and local cooperation.
  • Restricts funds from sanctuary jurisdictions.
  • Directs the Attorney General to ensure that information about aliens who have violated immigration laws is entered into and accessible through the NCIC database. 
  • Requires the submission of detailed information on apprehended aliens to DHS.
  • Provides grants to state and local jurisdictions for housing and processing aliens.
  • Requires ICE to establish 20 detention facilities.
  • Requires ICE to take aliens into custody within 48 hours of the conclusion of their State/local charging or dismissal process.
  • Establishes a training manual and pocket guide for local law enforcement on the enforcement of immigration laws.
  • Provides civil liability protection (qualified immunity) for state and local officers and their employing agencies when they are acting in good faith to enforce federal immigration laws or cooperate with federal immigration authorities.
  • Expands the Institutional Removal Program, which is used to identify and remove criminal aliens, and requires States to cooperate with the program as a condition for SCAAP funds.
